Liability Waiver & Release Agreement

Please read carefully before signing.I understand and acknowledge that participation in activities provided by The Traveling Tee LLC, including use of the golf simulator, hitting area, and related equipment, involves inherent and significant risks that may result in bodily injury, death, or damage to personal and company property. I knowingly and voluntarily assume all risks associated with participation, whether known or unknown, and I agree to release and hold harmless the Company from any liability arising out of or related to such participation, including claims based on ordinary negligence, except where prohibited by law.By signing below, I acknowledge that I have read and understand the terms of this Agreement and I further acknowledge and agree to the additional terms and conditions set forth below hereof and made a part hereof.

Additional Terms & Conditions1. Assumption of Risk
I understand that participating in golf simulator activities involves inherent and significant risks that may result in bodily injury, death, or damage to personal property. These risks include, but are not limited to:
- Golf clubs breaking, slipping, or being released during a swing
- Balls rebounding from the screen, frame, or surrounding structures
- Striking mats, floors, monitors, ceiling, or surrounding structures
- Slips, trips, and falls
- Malfunction or misuse of equipment
- The acts or omissions of myself or other participants
- Limited space in and around the hitting area
- The presence of food, beverages, or alcohol in event environments.
I knowingly and voluntarily accept and assume all such risks, both known and unknown, of injury or damage related to the use of The Traveling Tees golf-simulator equipment.2. Release of Liability
I hereby release, waive, and discharge The Traveling Tee LLC, including its owners, employees, contractors, affiliates, sponsors, and venue partners, from any liability, claims, demands, or damages, arising out of or related to:
- Personal injury
- Death
- Damage to my personal property or equipment
- Loss or theft
- Accidental harm
- Participation in or observation of the Activities
This release applies even if caused by negligence, except when prohibited by law (e.g., gross negligence or intentional misconduct).3. Responsibility for Personal & Company Equipment
I acknowledge full responsibility for personal and company equipment from the time it is set up until removed. I agree to:
- Prevent misuse or unsafe behavior
- Supervise minors at all times
- Follow all safety rules and guidelines
- Immediately report equipment malfunctions
I accept financial responsibility for any damage, theft, or loss occurring during my rental, excluding normal wear and tear. I authorize the Company to charge my credit card or seek other lawful collection methods for such damages.4. Indemnification
I agree to defend, indemnify and hold harmless the Company from any claims, damages, or expenses brought by guests or third parties arising from:
- My actions or omissions
- My failure to supervise
- Injury or damage caused by me or guests to others or property
- Claims brought by guests or spectators associated with me5. Safety Rules
I agree to follow all safety rules, including:
- Only one person swinging a club at a time
- No food or drinks inside the hitting area
- Proper swing awareness and spacing
- Keeping children, spectators, and pets outside the swing zone
I understand the Company may remove any participant acting in an unsafe or disruptive manner.6. Photo / Video Permission
I grant permission for The Traveling Tees LLC to use photos/videos of the simulator setup and its participants at the event for marketing and promotional purposes.7. Acknowledgment
By signing below, I confirm that:
- I have read this waiver
- I fully understand its contents
- I agree voluntarily and without coercion
